We are committed to protecting the personal data of all individuals who interact with our products and services. This privacy statement explains how we collect, use and protect personal data in connection with our smart charging stations, EV chargers, and our remote services for maintaining and improving the EV chargers, and for marketing our products and services to installers.

 

1 TO WHOM DOES THIS PRIVACY STATEMENT APPLY?

This privacy statement applies to our processing of your personal data as either the individual owner or user of our EV charger. It also applies to our processing of the personal data of the installer working for the installation partner engaged by the owner of the EV charger to install and/or support the EV charger.

 

2 WHO IS RESPONSIBLE FOR THE PROCESSING YOUR PERSONAL DATA?

Prodrive Technologies N.E. B.V., also operating under the brand Peblar, with its registered office at Science Park Eindhoven 5501, 5692 EM, Son en Breugel, is responsible, as the controller, for the processing activities described in this privacy statement.

If you are the owner or user of the EV charger, we are not responsible for the processing of your personal data by the installation partners you have engaged. As the owner of the EV charger, you are free to engage an independent installation partner for the initial set-up and registration of your EV charger, and/or support and maintenance services. To provide these services, your installation partner will need access, in a secure manner, to the data on your EV charger and your personal data processed on or via your charger. Your installation partner itself is responsible, as controller, for their processing of this personal data.

 

3 WHEN IS INFORMATION STORED ON THE EV CHARGER AND WHEN DO WE COLLECT AND PROCESS YOUR PERSONAL DATA?

Unique and generated device and usage data on the EV charger: our EV chargers are smart connected devices. They are easy to install and easy to use, allowing, for example, for easy identification to start charging. They also help with managing energy consumption and with easy and trouble-free charging. To work properly and provide you with these easy to use connected functionalities, the EV chargers need to have unique identifiers. The chargers also need to generate and store a range of technical and diagnostics data elements, such as the used unique identifiers, charging times, energy consumption levels, connection status, and details of any errors. These data elements are in any case stored on the EV charger.

Removing on-device data: if the EV charger is no longer going to be used because of deinstallation or permanent replacement, or if there is a transfer of ownership, we recommend performing a factory reset to erase all data on the EV charger.

Standard Connect Hub remote connection: as part of the installation, the EV charger will be securely connected to our Connect Hub, unless you as the owner, or your installation partner on your instructions, choose to disable this standard connected functionality. Through our Connect Hub we will securely collect technical status and device usage data and perform remote diagnostics. This connection and data collection is necessary for the optimal configuration, performance, monitoring, and improvement of the EV charger. It is also needed to be able to remotely diagnose and resolve errors on your request and to properly answer any support questions you may have.

Disabling the connected services: as the owner, you can at any time disable this connection and these connected services. You can do so by logging into your EV charger. By disabling, we will no longer be able to provide our connected services to you, which may make it difficult or more time consuming to service your EV charger or ensure its optimal performance. Therefore, we recommend keeping the connection enabled, particularly if you rely on remote services or anticipate the need for support. For more information on how to manage your connection settings, please refer to the user manual of your EV charger.

Access by authorized installers: our Connect Hub also allows the installation partner to securely and uniquely register and authorize with us to service and support the specific EV charger it has installed. Such authorization requires the EV charger’s on-device unique authorization identifier. Authorized installation partners are then only allowed to access the EV charger data upon the owner’s service request, and are not allowed to use data for other purposes.

Physical access to the EV charger and its data: if an error cannot be resolved by your installer onsite or remotely with our assistance, or if the remote services have been disabled, the EV charger may physically need to be send to us for service. We will then have access to the data on the device and collect such data as necessary to provide the requested service, resolve the issue and improve the product.

In addition, we collected your personal data in the following situations:

  • Individual owners and users of the EV charger:
    • Registration, and service requests: as the owner of the EV Charger, you can provide your personal data to us directly during the registration of your EV charger or if you reach out to us with support or other questions and requests. Typically, your installation partner will do the registration for you according to your instructions and provide your registration information to us. As a user who is not the owner, you may have your own (RFID tag) registration to authorize your use of the charger.
    • Using the EV charger: after installation, there will be a secure connection between the EV charger and our Connect Hub, as indicated. When you access or use the EV charger or the Connect Hub, usage data, such as timestamps, charging behavior, device identifiers or diagnostics, are collected automatically, unless you have disabled the connected services. If you are a user who is not the owner, your personal data will be processed if you have authorized charging with your (RFID) tag. If the device is sent to us for service, we will also have access and use this data.
      Installers do not have access to this data unless you have engaged them for support or maintenance. 
  • Installer: if you are the installer, you will need to register and provide your personal data to authorize yourself and access, install, and maintain the EV Charger. You can also indicate whether you wish to receive marketing communications from us.


4 WHICH PERSONAL DATA DO WE PROCESS?

4.1 If you are the EV charger owner or user

Below we explain why we collect and process this personal data, and the legal basis for doing so, via our Connect Hub or if the device has been sent to us for service.

-           Unique device identifiers ( IMEI, IMSI, ICCID, RFID codes, MAC address, IP and network addresses, network name).

-           Charger user data, meaning data on charging start and end times, duration, energy consumption, update logs, error messages, time zone, configuration settings, temperature and other safety logs, signal strength and connection status.

 

To configure, operate and maintain EV chargers, and to link sessions to users where relevant via the RFID.

Necessary for the performance of a contract, namely to maintain, and monitor the owner’s EV charger and handle the service request by the owner of the EV charger or the installer on behalf of the owner.

-           Charger data for trouble shooting, meaning device identifiers, event logs, technical error codes, connection, status, system logs from local and remote access.

For technical and support and diagnostics, either remotely or after return of the device.

Necessary for the performance of a contract, namely to maintain, and monitor the owner’s EV charger and handle the service request by the owner of the EV charger or the installer on behalf of the owner.

 

We also process this data for our legitimate interests to ensure product reliability, efficient issue resolution, and to improve our products and services based on the collected technical data and handled service requests. When we process your personal data for these interests, we ensure that the processed data is limited to the required charger identifier and the technical data. This data does not allow us to directly identify you. Moreover, we remove the charger identifier and further de-identify the data when the identifiers are no longer necessary for the listed purposes.

 

-           Device identifiers with data for product analytics and improvements, meaning the charging events and patterns, RFID scans, usage frequency, failure rates, system warnings, session status, firmware performance.

 

To understand how EV chargers are used and to improve system design, reliability and user experience. System analytics and enhancement.

Legitimate interest for developing and improving product functionality based on real-world use and service. When we process your personal data for these interests, we ensure that the processed data is limited to the required charger identifier and the technical data. This data does not allow us to directly identify you. Moreover, we remove the charger identifier and anonymize the data after the identifiers are no longer necessary for the listed purposes.

 


4.2 If you are an installer using the Connect Hub to the EV charger

As an installer with the installation partner of the owner of the EV charger, you will need to register and authorize to be able to use our Connect Hub and provide your services to the owner of the EV charger. Below we explain why we collect and process your personal data, and the legal basis for doing so.

To create and manage installer accounts, assign permissions, and provide access to the Connect Hub and related tools.

Necessary for the performance of a contract, namely for the service request and rendered by the installer on the request of the EV charger’s owner. Insofar you, as the installer, are an employee of the installation partner, we will process your personal data based on the legitimate interests of the EV charger owner and your employee to carry out the agreed service.

 

Installer user data:

-           Login time, access logs, IP address, actions performed in the system

To ensure secure access to systems, detect misuse or unauthorized access and maintain continuity of services.

 

Legitimate interests to ensure secure access and continuous availability of installer tools.

 

Installer contact data for marketing:

-           Name

-           Business

-           Email address

-           Expressed areas of interest

Direct marketing communications. To send relevant updates, product and services news, and marketing offers related to our products and services.

We will only process your personal data for these purposes if you have provided your consent. You can withdraw your consent at any time by contacting us using the contact details below, or by using the unsubscribe button included in our messages. We will then no longer process your personal data for these purposes.


5 HOW LONG DO WE KEEP YOUR PERSONAL DATA?

We retain your personal data only insofar as this is necessary to provide our services, perform diagnostics and maintain or improve our products. One (1) year after you no longer use our EV charger or Connect Hub or after collecting the data for product diagnostics and improvement purposes, where continued retention is no longer necessary, the data will be further de-identified by removing identifiers, and anonymized.

 

6 WHO WILL HAVE ACCESS TO YOUR PERSONAL DATA?

Your personal data will be processed by our authorized staff on a need-to-know basis for the purposes described in this privacy statement. If your EV charger is installed or serviced by an installer, the installer may access certain technical data of the EV charger in order to install or service the device. This access is granted through the Connect Hub and is limited to a predefined set of data necessary for the installation and remote configuration (such as the chargers unique ID and PIN code). After installation, installers do not have continued access and gain access only in the event of a service request of the owner.

Access through the Connect Hub requires:

  • A registered installer account; and 
  • A unique pairing using the chargers PIN and ID.

We also use services of third parties who process your personal data on our behalf, acting as a data processor, such as for providing hosting services and providing the functionalities and secure connection of our Connect Hub. In each case, we have concluded appropriate data processor agreements in line with the applicable data protection laws.

 

7 DO WE TRANSFER YOUR PERSONAL DATA INTERNATIONALLY?

When you are located in the United Kingdom (UK) and use our services, we will transfer your personal data to the European Union/European Economic Area (EEA), which is recognized by the UK Secretary of State as providing an appropriate level of data protection. The UK is also recognized by the European Commission as providing an appropriate level of data protection to allow the transfer of personal data.

Your personal data will not be transferred to recipients in a location outside of the EEA/UK. If your personal data are to be transferred outside the EEA/UK, we will take appropriate safeguards if that country does not provide an adequate level of protection according to the applicable data protection laws, including by concluding the Standard Contractual Clauses approved by the European Commission. You can contact us if you would like to receive more information on the measures we have taken to safeguard your information in this respect if we transfer your personal data outside the EEA or UK.

 

8 WE DO NOT USE AUTOMATIC DECISION-MAKING

We do not use your personal data for automatic decision-making or profiling that produces legal or similarly significant effects on you.

 

9 WHICH RIGHTS DO YOU HAVE?

When we process your personal data, you have certain rights. You can:

  • Request access to your personal data: you may ask us whether we process your personal data and, if so, request a copy of that personal data.
  • Request us to rectify or complete your personal data: if you believe that the personal data we process about you is incomplete or inaccurate, you can ask us to complete or rectify your personal data.
  • Request erasure of certain personal data: you may ask us to delete or remove your personal data in some circumstances.
  • Request us to restrict the processing of your personal data: you may request that we limit our use of your personal data in some circumstances, such as when you contest the accuracy of the personal data we process.
  • Object to the processing of your personal data: you may object at any time to our processing where we rely on our legitimate interests or those of a third party, or where we use your personal data for direct marketing purposes. If we rely on legitimate interests, we may continue processing your personal data only if we can demonstrate compelling legitimate grounds, which we will assess on a case-by-case basis. If you object to processing for direct marketing purposes, we will cease such processing immediately.
  • Request not to be subject to automated decision-making, including profiling: you have the right not to be subject to a decision based solely on automated processing, including profiling, if it produces legal effects or similarly significantly affects you. We do not make use of such automated decision-making in relation to your personal data as described in this Privacy Statement.
  • Request to port your personal data: in certain situations, you have the right to obtain the personal data you have provided to us and reuse it elsewhere, or ask us to transfer it to a third party of your choice.
  • Withdraw your consent: if we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. Withdrawing consent does not affect the lawfulness of processing carried out prior to the withdrawal. You can withdraw your consent with every marketing message we sent by clinking on the appropriate link. You can also withdraw consent by contacting us using the contact details below and letting us know that you no longer wish to receive direct marketing messages.

We will handle your request carefully and respond as soon as possible within the required timeframe. We may need to identify you and obtain proof of you identity to be able to respond to your request. If you feel that we have not handled your request satisfactorily, or if you have a question or complaint on our processing of your personal data, you can contact us using the contact details below. You also have the right to lodge a complaint with the supervisory authority if you believe we are processing your personal data unlawfully or in violation under your rights.

 

10 CHANGES TO OUR PRIVACY STATEMENT

We regularly review and update this privacy statement if there are changes in how we process your personal data, or if updates are required to comply with legal obligations. If any material changes are made, we will notify you accordingly.
